A tied vote in the House of Representatives means nine federal politicians — four Liberal, four Labor and one crossbencher — will not be referred to the High Court but Tony Burke refers fellow Labor MP David Feeney over his dual citizenship concerns.

Speaker Tony Smith used his casting vote to break the tie and see the motion defeated.
