The Papua New Guinea Ombudsman Commission has referred the prime minister, Sir Michael Somare, to the public prosecutor over alleged misconduct in office.
Earlier this week, Sir Michael lost his bid before the National Courts to stop the commission from investigating his personal finances.
His lawyers said he would appeal the National Courts' decision.
Sir Michael was under investigation over allegations that certain annual statements were not provided, or not submitted on time, or were incomplete.
The public prosecutor will now consider the allegations and decide independently whether there is sufficient evidence to request that a Leadership Tribunal inquire into the allegations.
