Could PM's appoitment be unconstitutional?

A legal challenge could see Tonga's prime minister and three other ministers lose their jobs, it it's successful.
A new political party, Langafonua Tu'uloa, claims the appointment of the four as Minister is unconstitutional, and they're threating a legal challenge in Tonga's Supreme Court.Party leader,Auckland based lawyer Sione Fonua, says two people's representatives and two nobles were made ministers in a proclamation by the former prime minister, Prince Ulukalala Lavaka Ata, in 2005.Mr Fonua argues that because the proclamation said that appointments of the four were for the term of parliament, they can't continue in office now that there's been an election in which none of them stood for election.
